There is one more thing that not many people are aware of.
Let me ask eveybody. Even after all this, why are these Desi consulting companys successful in the market? They have poor quality product (People with forged Resume), they are not charging lower rates, but still they are able to put there people in Projects?
could it be that their products work for less? I am not suggesting this: just pointing out that an anti-immigrant will pick up on this to further his cause. anti-immigrants use all kind of stats to show that their products do charge lower rates.

Hi Smartboy75 & Wawa, I also received the same update on Sep 28th ,I am in pending h1b transfer and uscis tried to reopen my previous approved h1b .
I am June filer and got all the receipts. Please keep me posted as well.

Did you change employer when you ported from eb3 to eb2, or stayed with the same employer?
- 2004 filed for Labor and started EB3 process.
- Company got acquired in later years . Filed new I140 ( I think it is called successor-in-interest)
- Recently started fresh EB2 process for interfiling of EB3 to EB2 . GC approved.

The next step should be to reply to the senator mentioning that the data is ambiguous and asking for a more clear response. Is it I-140 or I-485, does it include families etc. etc.
Also explain to them that based on these numbers, it will take X years for a person to get a GC and that the system needs reform.
I have worked with a senator's office for a completely different matter and they are very responsive - since you have caught their attention and already have a file open, it will be helpful to respond with a concise letter so that you can get more accurate information.

Read the term "Not to exceed 28.6 percent plus"That plus means EB3 total can exceed 28.6%..

USCIS is not dumb...They have interpreted the law in the way they think is appropriate....They are applying the over all 7% country cap to China/India EB2 and sending the overflow to EB3 ROW..... It is not fair but it is not exactly illegal...The law is open to interpretation and USCIS has chose to select this interpretation......You can take a crack at suing the USCIS.....I doubt that you would get anywhere......The EB2 India/China might benefit from the lawsuit....But as you know not all members would agree on IV spending resources on this lawsuit because this serves only a small section of member population.... At a personal level you can gather a few EB2 China India guys and have a crack at suing USCIS....
It says "not required by other classes". In this case it is required but could not be applied to EB2 due to per country numerical limits. Therefore it should go to unused pool of visas followed by AC21. Also why will USCIS prefer EB3 instead of EB2 people? It does not make sense.

Dude, You might be a new entry in to the ball of Immigration now. As said earlier , every one is free to judge and post the queries. If IV is shutting door of any questions you wouldnt have seen forum threads. There is enough discussion and direction taken on information being released to ALL members. Why one should complain IV not doing anything ?
here are some atleast, immaterial you agree or not:
1. If ppl are reaping benefits of EAD for multiple years , its becoz of IV.
2. whole of July fiasco was a win becoz of IV , not sure whether you are in the boat, but i can see the pain and how IV helped all of us.
3. all the admin fixes were co-ordinated by IV ,
4. The list goes on.. those 3 above are just enough to prove the help an ORGANIZATION did with minimal resources. Also please note none of the core are full time IV , they are also ppl like you and me.
Reason one has donor forum is becoz they are trusted sources. How can one know that you are pro-immigrant or anti-immigrant.
You would see dialy or minutes updates on sites of anti-immigrants becoz they have dedicated members and number base is too high.
Again , no one is shutting door against you, looking at your post i see you are shutting door against yourself just becoz your idea of Fax through AILA is not acceptable as an IV agenda.
Do you know first of all what provisions in CIR 2007 were in there which would have broke the back of ppl on H1 and potential immigrants? Can you confirm which provisions of CIR 2009 if there be one will help you ? will you support CIR even if it says you have to go back to india in no time ? AILA never mentioned in first place whether it would support EB community.
Plain simple, we pay Dollars even to newspaper ... You dont want to contribute for your own cause but get info for free and prove that will raise for your own cause. Those newsletters are for your benefit and collectively for the whole community.

The last CIR was like a bill from hell for us Legals. You can be very sure the coming CIR is going to be like this too ( with the job enviroment so bad ) . Unless we see something concrete helping the EB community in any bill , supporting it doesn't make any sense.
I don't want the transfer of EB unused visas to FB visa category. As such they already have much more visas every year .

ICICI can not predict rather no one can predict what will be the exchange rate tomorrow. The minimum forex transaction at dealer level is for $1 mil. So, they can't promise you some rate the moment you hit the submit button. They will pool all the transactions like yours and then do a big contract together. ICICI provides lot of other services which SBI will not in terms of convenience. And ICICI deals big time in forex transactions. In this market the guy with biggest transactions will have lowest cost and depending on competition will have incentive to pass it on to you as an end user. They might time it within a particular time frame but that is something unavoidable.

My case I-485 (marriage based) was received in Oct 2005, NC initiated Nov 2005, interviewed Feb 2006, pending name check since.
