Suppose you work for Company A on H-1B. You get out of the U.S. and come back with AP. You become parolee at that time. File an H-1B extension with Employer A, get new I-94 that indicates your status is now H-1B.
6 months later, you get another job with Employer B. Since you already are on H-1B with Company A, you should be able to transfer your H-1B to Company B.

Thats a very good point , If they dont count the dependents in Family based category , why are they counting in Employment Based category . Again may be rules are different but we can defiently raise this question

I think this is a valid point. We should request from USCIS to treat the employment base category same as other category. I am not sure that USCIS could fix this by themselves or they need any legislation.
This will be a big relief for us and will fix our 50% backlog.

bringing bk the discussion to more serious point. We can all agree that on the surface immigration system here is seems unfair towards Indian, Chinese and Mexicans. Whats the reason behind it? why only three countries which suffers from long waits. Its demand and supply. If there were no country caps, all the visa's will be absorbed by these three countries. Even though it has cost me time and money, i think its the right policy. for a moment imagine there was no country limit, can you imagine for few years to come immigration will be from only these three countries. i think its only fair to limit how many people can come from one specific country.
and one more point, we are never going to get treated with respect and equality, just get used to it. every American knows we left our country to come to his. he is always gonna look down upon us. Immigrants are never treated with love, respect and dignity, no matter which country they go to. Case in point, Bangladeshi and Nepali migrant workers in India. Is IV interested in doing a Freedom Of Information Act request to USCIS how and when they used up all visa numbers for EB3-India. That might show some information if they cooked the numbers if at all. We might get some more insight which monthly VISA bulletin does NOT give.

Good news but sounds too good too be true. On an average a family takes away 2.5 visas and going by this only 50,000 applications for primary bene is pending.
So if they are giving this info to Senator for free why are they asking us to pay $5K for this; unless we requested different information.

This case should not be very complicated. It is an "accident", you had insurance, you had all other legal documents to operate a vehicle. Why don't you consult a lawyer and ask to counter-sue for 5 million dollars - for emotional distress. An accident is an accident. It was on a public road and you were within speed limit. If someone does not want to get hurt they should sit at home their whole life and pray that the roof does not drop on them.
If you are sure you did not break any laws like DUI - just ask the attorney is you can counter sue.....may be they will drop the $3 million suit

If credentials were in Q, it would be pointless raising any Qs at all. Qs are only asked of whom you trust to give a reliable answer. While the Core and indeed the Donors are dedicated and smart, many members here are as interested in following the progress being made by IV and yes smart enough to understand that every organisation has strategies which it may not wish to reveal � the Qs here are not about strategy, they are about updated information and increased awareness amongst those IV calls its base. If a free and open discussion about this is only to be cut short by a member being told pay or not be curious, then this is not really a public forum and this needs to be clarified at the very start.
Of course IV can continue to get rid of people it does not like raising Qs by putting them down, but this is not the greatest public relations exercise - especially with the population the group seeks to serve. This world is not a one size fits all and - there will always be people who pop into a forum for the occasional Query - if we answered them nicely, updated them on progress, they may themselves consider this a worthy cause, donate, update their profile and contribute as best as they can. Alternatively they may never become donors, but will at least ensourage others to visit IV, become members, and support the cause. But if we ask them to fulfil multiple conditions before showing empathy, we lose them forever. My personal hope is that IV will succeed in what it aims to achieve, though it would never be by itself - many other orgnisations supporting legal immigration will be part of any victory should it be achieved.

From the article it seems Tancredo gives wrong information about H1b. Generally CNN is not responsible for any other person is giving wrong information in the interviews unless CNN accepts the information. Daily they are interviewing many people including Politicians and there is lot of chance for wrong information. Many persons gave wrong information about Iraq in CNN but CNN could not be responsible for that. If Lou Dobbs gives/accepts wrong information then we can complain about him in CNN. So if action needs to be taken we need to protest Tancredo for his comments.

Let us all have a rally to move back to our countries on 4July2008 to symbolically show that we want our Freedom and Independence and never return back.
If all the articles about reverse brain drain we are reading about is true they would do something to solve this GC situation. Otherwise the anti-immigrants will come to see us off while we depart this country and never to return back as H1B's trying to get GC's and live here. This will go into history, 30yrs from now and our grandchildren will read about it. And may be we will get some special pension at our home countries for returning back and helping it to do better.
