Thats a very good point , If they dont count the dependents in Family based category , why are they counting in Employment Based category . Again may be rules are different but we can defiently raise this question

I think this is a valid point. We should request from USCIS to treat the employment base category same as other category. I am not sure that USCIS could fix this by themselves or they need any legislation.
This will be a big relief for us and will fix our 50% backlog.

Folks I have an update on my case.
We filed for Motion to reopen on which were receipted on March 27th, 2009. I wrote to Congressman, Senators and also Ombudsman. Today my congressman's office got an update that our MTRs were approved on April 30th and our 485s got reopened and they have sent letters to that effect.
What a relief. It was a stressful 6 week ordeal. Thanks to IV and its members for the help and support.

USCIS cannot keep the filing fees if they return your application. They can only keep it if they do accept it and then deny/reject your application.

Don't worry - IV core will appear out of the blue when:
1)- there is a good news - to claim the responsibility (regardless whos efforts)
2)- when they are in urgent need of funds (don't ask just give)
Local chapter is a joke for most of the states, in my state there were only 2 meetings in 6 months and in second no one came including organizer :D
So basically by not joining local chapter you are not missing anything! trust me :)

There are many good strategies but I have no idea on sophistication of each individual. For example right now you can sell credit default swaps on Goldman sachs medium senior secured notes and hedge it with delta units of binary in-the-money call options on the VIX. This will give you synthetic exposure to the notes with steady cash flow and the binaries are cheap. If goldman defaults the VIX will sky rocket giving you a handsome payout better than what you will have to pay on the senior secured notes because of high recovery rate if all the default climbs up to the senior tranche. Actually this would be equal to the end of the world in today�s market.
Or better yet just buy SPX and sit, the market is doing all the work for you.
The US natural gas market is in contango (I swear this is not jargon:o, there is no other term). So buy long dated/leap calls at the money now. In 2 years you will be so deep in the money you wont know what to do. But average retail investor cannot hedge this as he cannot trade spot.
So I guess my point is there are sophisticated ways to make money for which the average retail investor has no access to. If there is a simple way then it has already been exploited under the no-arbitrage clause of free markets.

According to exhaustive research done by Vivek Wadhwa, executive-in-residence at Duke University, if highly skilled immigrants in the U.S. don't have a chance to stay here permanently, would-be entrepreneurs take their skills back to their home countries—where they compete with U.S. companies instead of founding them.
There are 140,000 Green cards allocated for highly-skilled workers and their dependents in a fiscal year (unused visas may not be rolled over to the next year). However, due to over-subscription, thousands of highly-skilled workers, including engineers, scientists, MBAs and health care professionals have been waiting patiently for years in order to be eligible to apply for their Green cards.
Now, these highly-skilled professionals have decided to call attention to the "broken" immigration system in the U.S. for legal immigrants. Earlier this week – the community received widespread attention when hundreds of them sent flowers to the USCIS Director, Emilio Gonzalez. You are right..it takes time and effort, and money too. We are ready to donate, if we are allowed to file EAD after 140 clearance immeditely, ,irrespective of EB-2 or EB-3. However, do not reply saying that you need to donate first as this is not how we think. There are a whole bunch of friends who are of the same opinion.

Juist to prove the original posters point about IV being intolerant about different points of view and the trigger happy attitude of some members about giving a red dots just because someone else speaks his point of view - I got a very personal and abusive remark with a red dot just for my post above. Not that I really care about Red or Green dots. My GC journey is over. This forum helped me a great deal when I was waiting for my GC. Now I am hear to help others with what I know in their GC pursuit and help with any on going action items. Just wish some members here would grow up and learn to live and let live! :)

After reading through all the posts at IV, I've decided to get the Atlas America Medical insurance for my parents. This is the only comprehensive insurance I could find and most others have limited coverage. The cost is around $900 for 3 months for a $500000 policy with $2500 deductible.
Could members who had this insurance post their experience?
Also, is there any other comprehensive plan available for visitors?
we used IMG international's/sirius international patriot america with a $250 decutible 90/10, for 50K...
one thing I noticed is this company takes a long time ( most other visitor insurance companies too I suspect) for settling cliams..we still have a claim not settled since for a one in december and most of these dont cover pre existing conditions and they are very very restrictive.. however there are some insuranc companies who provide a rider for pre existing conditions for an extra dough..
just make sure to call them for any major visit (hopefdully not needed but in any case) , the one above we got was a comprehensive NOT a limited one..still I think these insurance carriers in my opinion do their best to delay the claim and do whatever they can to sneak up on you with a surprise

Fraud is not correct word, it is because of lack of policies or loop holes in the current Immigration System. This can be found in any system, any country, any people. So, there is no need to talk on that. It is better to put our EB related retrogression problems to Congress and no use in discussing these. Otherwise If you start discussing on fraud, every work done by everybody is going to have some kind of fraud. It is to survive and so people do whatever it is, with in the limits of law.
All people who are being labelled as socalled "Americans" came here like immigrats and theft the land from Native indians. So, everybody is doing wrong. That's part of time. So, no need to blame just few. It is being done by everybody. So, please skip the topic and focus on the our current problems.
