Let us list our the reasons for not complaining
If you are on a H1B
- Employer is withholding pay for 4-8 pay periods and leaving the employer would lead to losing the money
- DOL and USCIS will not be able to recover all the money the employer owes per the employment agreement even if it reported. They might only recover the $$ mentioned on LCA
- Employer does not run paychecks periodically so it might be hard to find Jobs and do a sucessful transfer of H1B visa and start the Greencard process all over again
I485 filed cases
- Employer withholds documentation and/or does not share documentation related to Labor/140 etc to be able to utilize AC21
- The Job description that was communicated to the employee while filing the Labor does not match the employee's field of work and the employee has not reviewed the LC prior to signing
Anything else?

Finally I am a US citizen after being 10+ years in this country. This is one of my biggest fulfillments and it means everything to me. US is just not home anymore for me, it is my country.
I wish everyone the best and hope they get GC very soon.

Sen Grassley makes sense to me. It looks like he has thorughly studied the program. If he is really concerned to stop the abuse in H1B program then
a. H1B visa should be decreased
b. EB visas should be doubled
c. Current backlog should be cleared by recapturing visas.
If we are all on the same level playing field, then there will not be a chance of lower wages & the employers will only recruit based on true skills.
In either case, Americans need to be more competitive, rather than just crying that I am replaced by a H1-B. Why would any employer sponsor an H1B visa when he has equally qualified US citizen.
Hope the senator understands both the sides of the same coin, just reforming H1B will not help much. It will result in outsourcing. EB visas should be doubled.

This is in reference to a thread about feeling depressed by retrogression or labor backlogs to stuck FBI namechecks or whatever it is that depresses you. Not criticizing anyone in particular so dont aim for me.
Yes, and a lot of people know that there are highly skilled people who are depressed and that takes a toll on employee productivity.
After all, if 90% of your time is spent on thinking about BECs and visa bulletins, imagine if that time was spent on doing the job they've hired you for.
Some employers(like Microsoft) realize this and want to do something about it. Its not just about keeping the best and brightest here in USA. Its also about keeping the morale and productivity up.
As to how to deal with this...try this.
Call your local congressman's office(Find out info about that from House.gov, with your zipcode). Get an appointment with congressman. There is an Easter recess coming up when they would be back from DC.
Then talk to him about all issues you have. Take all the material you need from the "Volunteer" menu item of this website.
Doing something about the problem is the best therapy there is. I am not saying this because I want to coax you into meeting your congressman. No. That's not the objective. But I think action is the best remedy for this problem. And there is actionable stuff to do about this. If you are suffering from terminal cancer, then you really cant do anything about that. This is not such a problem. This is a problem for which the solution is out there.
Somehow, after landing in this country, people lose the appetite for risk and adventure. Before they are in here, they would move mountains to score an H1 or an F1. After coming here, they hunker down, heads-under-the-desk kind of approach. What I am talking about is nearly 200 people right now, who have read this post, but havent logged in. They wouldnt log in. They wouldnt give their real email address if they sign up. They would never contribute. WHY? Because they are afraid. That they will be deported. For no reason. Everything we do is legal, including raising funds and spending it on lobbying. But they are afraid. They are also afraid that by talking to congressmen, they will make them mad and the congressman will pick up the phone, call USCIS and then get their 140 cancelled. Yes. People create their own fastasies and become afraid of them..

They were illegals. Yet, the somehow managed to walk into the building where laws of this country are made, talk to people who make the laws that they have broken, go thru Capitol Hill security check, and look into the eye of the lawmaker and talk to them.
However, our community, this is how they behave. Forget about talking to congressman, or contributing money. When they call the core group with a question, they block the caller id can call. Dont disclose their name too. Ask a questions and then quickely hang up. Some of them want to contribute with cash because they are not willing to believe us that we are doing everything legal here and its their right to lobbying and petition the Government for problems.
After paying taxes, after following all immigration laws, after getting all the education in the world to become "Highly skilled", the highly skilled cant bring themselves to stand-up with a straight spine, thump their desk and talk to their lawmaker.
So at the end of the day, if we are depressed that legals dont get attention, then you know where to look for blame : the highly skilled who are highly educated and too afraid because their education and skills make them think too much and analyze too much, and they are afraid all the time.

I got a ref today the reason ability not to pay. They state that in line 21ordinary business income is less than what it should be according to PW and based on that employer was not able to PW in those years like from 2001 to 2006but the gross income was always in between 600000-1000000 each year. but can they relate your old returns with new PW. I mean does it matter based on your last 5 returns ability not to pay but currently I am drawing more than PW and my employer never filed tax`return with loss. pl. advice Does I need good CPA

The petitioner must show the ability to pay since establishment of PD. It does not matter if you get paid more than proferred now . Getting paid more than proferred wage always helps.
If the petitioner has more than one immigration petition pending then he has to prove that he has ability to pay for all petitions simultaneously since each petitions respective priority date.
Declaring profits help but again one has to put everything in context of immigration petition. If you got paid 10k less than proferred wage in a particualr year , petitioners profits must exceed 10k for that year. If there are 10 petitions pending in a year and all of them got paid 10k less than proferred wage petitioners profit must exceed 100k. I am trying to a put a simple example here . A right lawyer or right CPA may have ways to overcome these things.
Looks like a good sign in your case is you filed in May 2007 , is that regular or premium processing case? If it is reg processing case then looks like INS is processing cases based on PD which is a good thing should help lot of BEC folks.

Guys,
I feel privilieged that I have an opportunity to work with the same employer as Aman. I remember talking to him one year back, when he first mentioned retrogression. Like many others, I was naive and thought I dont have to worry about it until 3 or 4 yrs. I have seen him in action, he is the most polite human I have ever came across, who is super soft in his heart but super agressive in his actions. I know that he sold his house to generate 64K to spend for IV.
He once told me that he likes to socialize with fellow employers, indulge in office politics, etc and be a typical employee, but unfortunately he cannot because he would rather spend that time on IV and build things for IV.
I know for a fact that, his boss is not all too happy about he dedicating his time to other efforts. But he stands like a pillar to protect our IV community.
In a nutshell: Here is a man who is willing to give whatever it takes to stand up for what he believe in. We the community should be extremely happy to have people like him and Logiclife.
I will start my $20 dollar contributions / per month recurring contributions today.

So next step enable 5$/ month to 100$/ month RECURRING contribution arrangements ASAP.

I will call the senators immigration liaison tomorrow. Hopefully she will not tell me that they cannot do anything besides what they have done because that is what they told me in September last year when I got a standard response last year.
Unfortunately nobody understands the pain and agony we are going through. For them, its just another day at the office, they couldnt care less. Nevertheless, I am going to try tomorrow.....hey, cant give up that easy.
I will call CS again tomorrow, I dont mind being yelled at and I am gonna tell her this time that I have not opened a SR. Atleast, she will then transfer my call to a IO.
Let's see what tomorrow has in store for me!!

Another constituent sent me a letter saying that he saw firsthand how foreign workers were brought in while Iowans with similar qualifications were let go. He tells me he is a computer professional with over 20 years experience. He was laid off and has yet to find a job. He states: I believe [my employer] has a history of hiring H-1B computer personnel at the expense of qualified American citizens.
I received a letter from a man in Arizona who works for a company that employs dozens of H-1B workers. When he asked his supervisor why so many foreign nationals were being hired, the head of human resources said: If the company has an American and a person from India, both with the same skill set, the company will hire the person from India because they can pay them less. These are firsthand stories from U.S. workers.
I ask those begging for an increase in foreign workers to explain these cases to me. Why are Americans struggling to get jobs as software developers, data processors, and program analysts?

FIX LEGAL IMMIGRATION FIRST!
Of course, now we risk alienating the "undocumented worker" community, but is that such a big deal given we're legal and struggling and hoping that America does the right thing to get us out of this gray area... ?
On a different note, I can't wait to see what an EAD and AP looks like. When does the clock start ticking? Is it 90 days or 180 days? :)

We might apply for EAD and AP but what if they throw our papers some where and repeat the same thing.
This time they will be very careful in issuing visa bulliten
In future very slow progression in visa dates...adjudicating cases very slowly always stating that due to july visa bulliten we have lots of cases ...we will not be able to do anything until we sort ou...blah blah...

We should be firm with our goals...
Lets come up with some ideas....

Please remember that ICICI gives LIMITED coverage for anyone above the age of 56. It is mentioned in the "fine print". They have a restriction of say $1200 per day of hospitalization (not sure of the exact amount- but somewhere in that region).
The same is true for TATA Travelguard
It sounds like Comprehensive Insurance from a US company might provide the best "insurance"
Don't ever go with ICICI Lombard, they are jerks and cheaters, I took it for my mother and they have not educated her properly while taking insurance from them, when it comes to claim, they have given penny, saying they have applied sublimits in her claim, and they took too much time to pass a claim of a chunk, I really hate this company, don't go with them,

Don't ever go with ICICI Lombard, they are jerks and cheaters, I took it for my mother and they have not educated her properly while taking insurance from them, when it comes to claim, they have given penny, saying they have applied sublimits in her claim, and they took too much time to pass a claim of a chunk, I really hate this company, don't go with them,

I guess I may fall victim of FBI background check. Even though, my priority date is not current yet but, it should be next couple of months based on recent EB-2 movement. We had our AOS interview last Nov and IO told us that she is going to initiate another Background check as original BC is more than two years old. In the end of April, I made an Infopass appointment out of curiosity because Background check use to be a major source of delay for many people. Service Rep on window told me that my Background check has not come back yet.. It was almost 5 months since it was ordered.. She did not elaborate on why was it pending.. She asked me couple of weird question which did not make any sense to me. I have schedule another appointment in next couple of days to find out where do I stand. I would like to keep my expectations in check as pending BC can delay it even when priority dates are current.
Can anyone on forum please provide some info on what can be done if Background check is pending over 180 days.. I can make a request to my Congressmen and ask for their help... Any suggestions will be greatly appreciated..
