After talking to my lawyer, I have decided to forego my H1B renewal and instead move to EAD. This allows me the flexibility to move to better roles with my current employer, as well as other employers.
As has been mentioned on some other threads, the most common reasons for your I-485 denial (fraud, out of status, communicable disease, criminal or felon etc.) would probably also mean that you are ineligible for an H1B too. As long as you are confident that you do not fall into any of these categories, the risk is very minimal.

I have tried to put my career goals ahead of the dollar conversion rate (not always easy). Because i took up new roles and salary , i have had to restart the GC process a couple of times. As a result i am still without GC despite being here for more than 10 years and having two masters degrees from US. I am sure this is a common story here.
I am heading towards a another change and now have very little patience for restarting the process. I am glad many people on this forum have voluntered to help pack. I will be getting in touch with you in a few months.

I already saw a complaint on change.gov that 'people representing special interest groups from foreign nations may be flooding the change.gov system with messages and votes which may not be in interest of Americans, for whom the Obama administration is supposed to work for."
That said, let's continue to send messages and make our voice heard anyway! Good work folks!
I put mine in, let's go for more than 100 and don't forget to "bump" this message so it stays at the top!

Mr. Dobbs is known for his strong views against immigrants, including considering immigrants to be responsible for the spread of incurable diseases such as Drug-resistant Tuberculosis, Leprosy etc. From past experience on CNN, he is also highly likely to blame the current crisis in Auto Industry to the so-called "importation of cheap labor from third world countries".
Lou Dobbs Tonight 03/28/2007 (http://transcripts.cnn.com/TRANSCRIPTS/0703/28/ldt.01.html): "It's pretty remarkable. Four hundred thousand H1 visas each year."
From How many H-1B visa workers? Counts vary (http://immigrationvoice.org/forum/showpost.php?p=114543&postcount=737) VALLEY EMPLOYERS AMONG TOP USERS By Chris O'Brien (cobrien@mercurynews.com or (415) 298-0207) | Mercury News, 07/15/2007
The federal government awarded 124,096 H-1B visas in the fiscal year ending October 2005, the most recent annual totals available. That includes renewed visas, which don't count against the annual cap.
From Characteristics of Specialty Occupation Workers (H-1B): Fiscal Year 2005 (http://www.uscis.gov/files/nativedocuments/H1B_FY05_Characteristics.pdf)
Page 5: Number of H1B petitions approved for initial employment is 116,927. The number of approved petitions exceeds the number of individual H-1B workers because more than one U.S. employer may file a petition on behalf of an individual H-1B worker.

Yes but do note you do not have endless time to file a complaint. I don't know how many months you have to file a complaint after leaving your job but I know for sure there is a time limit.
QUOTE]
I think its 3 years from the event, that you have to file a complaint. If its past 3 years, you cannot file the complaint. The event may be such as you left the employer and your employer withheld your last paycheck(very common issue with desi consultants) in the name of covering your H1 expenses etc.

25K "members", 30K goal, 24 (excuse my French.. ) freakin' days... and once the momentum from this round of lobbying dies down, we're back to square one, with the begging bowl.

Jazz,
As far as the fund drive is concerned I disagree that without the VB we would have not reached our goal We over 22.5K in 6 days. The VB provided a push but I am sure we could have collected the remaining 7.5K in 24 days.

Atleast this new rule would help speed up that process. 45 days is certaily achievable. attorney must do a good job while asking for the documents upfront.
I dont think companies are really geared to file for 140 within 45 days of labor approval.
Most of the companies take 4-6 weeks to just send the documents the lawyers request for filing 140. Then the lawyers, most likely forget something and request more documents. It takes another 2 weeks for company to send those.
All in all, on average I think companies need 3 months after approved labor to be ready to Fedex that 140 petition. No malicious intent on the part of employer, its just how things are. 45 days is going to make things difficult for many companies and many of the lazy, slow, procrastinating law firms.

Nope. You are misunderstanding the point again.
The Article clarifies that that Congress has the power to regulate immigration. they used the power and created the INS laws we have today, which as per Congress is the hallmark of US immigration. We have to change those laws specific to EB.
You are muddling immigration laws with civil rights. Your argument about the current law being in violation of ANY constitutional right is completely baseless. You did not respond to my question about how the civil rights clauses you quoted have anything to do with immigration.
They used the power. No problem. But how?
Let me quote an extreme example.
If they make a law saying, a foreign woman may be raped at port of entry in exchange for citizenship, will it stand?
NOW do you see the connection between immigration and civil rights?

shishya and spdy_mn, the point here is when did you get married. As long as your marriage date is before the approval date you are fine. In fact, I remember reading in murthy's website that even if you find out that your 485 has been approved right after you got married (all petitions will have an approval date), you are still eligible to file for your spouse's 485. I think INS has a 180 day window to consider the spouse's application. I guess you have to prove that you got married before the approval date of your 485. Search the murthy website about this posting from her. Good luck.

I am not sure if that is going to be an advantage since my PD was not current in JUNE
who knows? immigrantconnect.com reported that they heard that some applications were approved in june even when the pd wasn't current in that month. i wouldn't worry about it.
