My wife couldn't do TB test since she was pregnant when we filed I-485 in Aug 2007. Now she is in India and be back only in the first week of June. If we receive an RFE for her TB test ( my PD is EB3-I Oct 2003), can we request an extension for RFE? Is that possible?
-GCisaDawg
My fear came true today. USCIS issued a RFE for my wife's I-485 TB test and she is in India right now. RFE has May 6th deadline and she would be back on June 3rd.
What are our options?
Request an extension for RFE?
Pre-pone her trip? (this would be really a costly option for us...since we have so much planned around that date)
Do TB test in USCIS approved surgeons in india (If there is any)
Thanks,
GCisaDawg

Folks, I took 100K coverage with I!M_G*G#L^O&B(A)L through the agent I*N*@S#U^B%u^y.
Unfortunately one week before my dad left, I had to take him to ER as he had an attack. The bills came out to 50K+, the insurance company denied all claims saying it is pre-existing.
The hospital and the doctor who attended him at ER as well as the hospital gave me a letter saying it is not pre-existing. But insurance company will not accept it.
The guy at the agent, talks nicely but he says we cannot do anything, just go in understanding with the hospital and pay it in installments. He also says do not file any law suit it is not useful.
All this is total scam, i did pay a huge premium but now i have lots of bills to pay.
So i agree with others, please do your research properly. And do not believe sales guys or agents, they will talk very nicely but when it comes to claims you are on your own...

[QUOTE=sachug22;261611]We know:
EB1 and EB2-ROW was current the whole year, which means there are not many pending+ready cases.
They have used all EB3 visas.
What they are left with is 20,000 visas(10-15% of 140,000 since more than 80% was used in first 3 quarters). This will be mostly for EB2 India/China.
They may not have enough pending+ready application for pre-april-2004 (previous VB). So they had to moved the date forward to get enough applicantions not to waste the numbers.
I think the above reasoning is right. They have many visa numbers left and also have visa numbers spilling from EB1. They dont want to waste it (finally!!) thus moved the date forward to approve many visa quickly as they did June 2007 before July fiasco. They approved 30-40 K applications at that time.

Guys: Feel free to make new entries, but let me know what one u choose for the polls :D:D
So we can show multiple entries? But still only vote on one... sounds good.
I'll show this one for now then... It kinda sucks, but I plan on making a better one soon(which is why I hadn't uploaded this one yet).

Yes--Universties--come under non-profit as per INS, hence exempted from quota, but not Elem/Middle/High schools.
I got my H1B from a University starting Aug. As far as I understand, there is no H1B quota for non-profit. I also have a US degree. There is a separate H1B quota for US educated.
I don't know where I was plugged in. I don't remember any details.

I think you missed my point...we need more members because you can't get any one's time if you just want them to do something for you. You have to be prepared to do something for them. For us, when we become citizens, we need to vote. Now do you see why political parties look for numbers?
Also, as far as our outreach in the news media is concerned, you should look at this page:
http://www.immigrationvoice.org/index.php?option=com_weblinks&catid=19&Itemid=27
We may not have made the news on CNN or on PBS, but we have gotten the word out across a wide spectrum of the news media...

Yes, I obviously cannot diasgree with that logic; it is all about votes.
But, I looked at the articles that you point to above: The one in WASH POST is about illegal immigration. There is no article in NY TIMES. We need the big newspapers and PBS to discuss our issue repeatedly. Also, many of the newspapers mentioned there cater to Indian population, e.g., Times of India. Plus shusterman.com will always report about us. He is not a part of the wide spectrum of media.
This is a problem with what we are doing. The media does not know about our plight; all they know is that many of us came here on H1B.
Also, all these articles should be on a sticky thread for all to see where we have been heard.

It is Question Number 23 now. But, if you sort it by most popular, it is Question No. 48. We need to get more votes to make it a popular question.
Any chance, the candidates will answer this question

Just finished calling the offices of all the representatives listed for Phase 3. Took me about 15 min to complete it. Left a voice mail for congressman Calvert's office. They staff persons were all very polite and did note down the information and mentioned that they'll pass on the information.
Urging more members to call and keep the momentum going. I will try and ask some of my friends affected by GC to participate in this activity as well.

We have to understand that there is a myriad of laws; INA, CFR's; USCIS policy binding memos; internal memos; appeals decisions, court cases, precedent aao decisions, precedent legal cases.
Now; the ac21 memo is a memo that uscis officers have to follow. However; the memo is not in accordanc with INA 245 or AC21.
INA 245 states that a valid and approved 140 is needed for a person to get lawful permanent residency.
ac21 says that a person can change jobs after 485 has been pending for more then 180 days.
The above two things are the law.
In ac21 law; it doesn't say anything about the scenario if 140 is revoked by employer. It is totally silent to it.
USCIS in their memos realized that ac21 law would not have any meaning if the employer still controlled the 140 if a person was eligible for ac21; therefore, they issued the memo (memo is not law but binding; memos can be changed; however, there has been nothing public about any possible change).
Memo is clarification which they have been following for many years and as far as I know still binding.
If we look at all the denials on 485 - when 140 is revoked the officer quotes "INA 245" and when MTR is filed - the case gets reopened stating AC21.
It is clear that AC21 supersedes the INA 245 rule.
Ability to pay is an interesting topic but I don't think this kind of denial has anything to do with ability to pay.

i am with you. we should request that USCIS recapture unused visas!
Lets ask Core not to just go with the temporary fix of July visa bulliten.
We might apply for EAD and AP but what if they throw our papers some where and repeat the same thing.
This time they will be very careful in issuing visa bulliten
In future very slow progression in visa dates...adjudicating cases very slowly always stating that due to july visa bulliten we have lots of cases ...we will not be able to do anything until we sort ou...blah blah...
This is not the fix
We should be firm with our goals...
Lets come up with some ideas....
Lets not ask what to do...lets think and come up with an idea...and then we shall decide if it works or not...
When some one first suggested flower campaign everyone took it as a joke...it was not implemented before some one sent the flowers and showed the receipt number...
I was following core for a long time...this the biggest response i have ever seen from the members...
Lets continue it...
My idea ...lets not just accept the temporary fix...we should fight the congress until they come up with a plan of fixing the GC issue.
The congress talks about fixing illegal immigration..Lets ask them to fix the legal immigration first.
Unless we are really strong about it...nothing can be accomplished..
They cant fix the existing legal system but they are ready with the plans of fixing illegal immigration...of course it failed but still they had big impact...

See what I mean. More than stat-arb, the HFT programs keep looking for pattrens in order flow and front run them. Thats why you have lattice trading and when a fund wants to sell a big block, they dont even go to the exchanges. they pick up the phone and call someone "upstairs"

You do NOT have to go anywhere - what you are saying is "SBI Rapid Remittance" by SBI where the money will reach your Foreign account the very next day ( But you might have to wire the money as well to BOA-NY or SBI-NY ?)
www.onlinesbi.com/rr - This is SBI's response to rapid exchange.
What i'm talking is "SBI Direct Remit" & takes 3-4 business days but just click of computer mouse once you are set up. I actually set it up Monday morning EST and Friday Morning EST i see my money at Foreign account. No need to open a account at SBI-NY or anywhere but its good to have the target account at SBI ( it can be your mom/dad's SBI a/c or yours , doesn't matter really )
www.onlinesbi.com/glsus
P.S: By the way - i also had the idea that SBI is "sarkari bank" - slow , unprofessional etc... etc.. But the band of peoples who handles this division are really young and bright - my experience for last 6 months is just terrific. Customer Serivice also replies via email the next morning ...
Good info, thanks. I recently registered with the SBI NY (http://www.statebank.com/) branch office, to use their remittance service to send money home (to an SBI India account), but you have to fill out and mail a remittance form to them each time you want to do this.
