I completed my MS in Computer Science from US around 6 years back, was on OPT for a year & thereafter moved out of US and came back to my home town. Have been working here for 6 years now as in the software field & have now applied for H1B under masters Quota. Was wondering if I am eligible to apply under this quota as I am neither a fresh graduate nor have any status in the US. Also, my lawyer has only filled out the I-129 form. Is there any special form that needs to be filled out to be considered for Master's quota?
    Please reply

You are eligible to apply under masters quota. There is no special form for the masters cap. However, lets hope that your attorney has checked the box of h1b for "US Masters" and send application to USCIS with ATTN: H-1B U.S. Masters Cap

This is the reason I would not want to give the ASC info. People will start bombarding the office, like they misuse the POJ method calling for nothing.

unbelievable.. cableching, why are you so concerned about ASC? just go home and sleep. I think you had your fun for the day.

    Hi

We don't want to create more divisions based on how they got in to queue for GC. As a matter of fact, my company filed I-140 based on a old labor, where the skills were matching exactly and the previous person left the company. The company that I work in has 8500 employees, I was not even aware that they filed premium for I-140. I did not have to pay dime for all the process.

Pls remember filing substitution labor was legal back then.

However, USCIS removed this provision in 2007 and the discussion ends there.

When you compare all other issues that are the root causes for the retrogression, we are spending the time and energy on some thing that would not help any one.

    Thanks,

Yes It is legal. People are having issue only with hijacking the Priority dates. That can be questioned in the court. Original policy was to assign the date of I-140 filing was the Priority date . There are memos with that policy. But when and how it got changed no one knows.
So that is best candidate for suing USCIS and get the green card faster.

According to a specialist on immigration forums "Mr UnitedNations" the unused visas are directly being used for EB3 ROW , I am not how he knows that but maybe thats what is happening.

Maybe EB3 ROW being a diverse group is being given more precendence than highly subscribed countries.
This information was there on a visa bulletin. This is not a guess but a confirmed fact.

pappu, pls let me know, if u received the fund. Also, one small suggestion, we can just maintain a small excel sheet, to just see who (just the user id and not the actual name) contributed and how much money they contributed just in this campaign. Cos, I hate to say this, I just dont want to be around those who want to have a free ride from all the hard work that IV group is putting in. Please everyone please donate. If you are reading this post, if you have not contributed earlier, please contribute. Dont you want IV to become strong financially when fighting this tough case. They need all the help they can get. So, please anyone who is going through this forum and not contributed earlier, please do contribute. This will help us go a long way. Thank you and god bless IV.
Thanks. It is tough to keep a sheet. but if people just post a note on the forum that they paid it will help keep a tab on #of contributions. It can be verified and we will know who has contributed.

You may idolize a super cop or a good cop. But without basic humanity he is not even a human. You might red me on this perhaps. But I would not as its your view and this is my view. I hope other fellow IVians will acknowledge this.

This is ridiculous. Just trying to blame a good Sherrif.

I am from AZ and Sherrif Joe is the best and the whole country should be proud of him.
He is doing the job which is supposed to be done by Federal govt and ICE, trying to take care of a border state county.
Well you always have critics when you are doing a good job or he wont keep getting elected again and again.

We have known Rosa Park personally and she was a speaker at one of our meetings and let me tell you none of you are close to what she was.

It looks like you are planning to go to DC. There is big difference between planning and execution. You folks are theoritical and not practical. This time the bus will be empty. You just don't have it in you. Take it from me.

BTW it's Parks not Park. Of course she was a great lady. If any one of us are close to her, no one really knows. Not ever you. Maybe we will get a "Rosa Parks" in this rally. If that happens you will write:

"We have known "Rosa Parks" and she was a speaker at one of our meetings and let me tell you ........"

You seem to be having lots of Good Ideas about funding. you also seem to have the art like you mentioned in your post. Do you want to take the lead on a Fund Raising Drive?. We will be happy to hand this over to you. Have Fun :-)

I never claimed any amount for this holiday gift on this thread yet but what if I want to donate $31 or per say $ 81 one time, I do not have that option now and so I will end up not donating now and wait and donate when I feel comfortable with $ 100/- or its multiplications. That is called turning away and if you guys do not see any danger into it I do not have any further words.

Fund raising is an art and I believe our current startegy is lacking that art. If you guys see the base of any major successful fund raising (Grass root level not Political ones, mind well we claim ourselves grass root level organization)you will always find donors with $ 1 to donors with $1 million donatiing as per their will. Grass root level fund raisings can not afford constraints which normally goes successful in political and/or industrial fund raisings.

Some of the strong supporters of current policy, in their argument, automatically assume that willing donor always used to spend $ 100/- frequently for drinks or food and may be living lavish life style. But they are partly wrong in their assumption...I myself never eat outside frequently. Even on a travel trip I cook my food by myself and I normally do not drink sodas or alcohol so what abhijitp has given a example at least does not remain valid for me but I can not say that it is completely out of proportion, as it has some valid logic but it can not be true for everyone.

Point is if we make a wrong based fund raising policy, we may hurt ourselves only. I know my option, if I want to donate odd figure now, I will not be able to donate it now, and I will have to wait till I feel comfortable donating $ 100/- and/or single digit multiplications of $ 100/- but would that be considered a good and wise option?

For an example, I am emotionally charged today and I want to donate $ 61/-(As I may plan that much only..for whatever reasons) but I am not able to donate so I will not donate and say after 4 months I will be able to plan $ 100/- but what if at that time I may not be emotionally charged to donate all together? So end effect would be I will end up donating nothing ( This is just an example..:))

And for the sake of argument if you enrolled yourself $50/- recurring, you did it willingly and so would you change to $ 25/- recurring if $ 25/-option is available to you? (Note: I think most people on this board fear that with having a minimum amount option, most people will turn to that only but that may not be 100% true. and even if it may become true it will end up having more donation flow) For most people answer is no, I believe, They will stick to $ 50/- recurring option as they can afford and they did it willingly. But with current policy we are completely turning away the people who may otherwise donate, for an example $ 20/- monthly-recurring policy may turn 40 new commited donors in whereas $50/- recurring option is creating only 10 donors and thus we may be ending up $ 300/- confirmed donation loss per month. This is just an example and based on assumption that less amount would attract more commited donors.

Having said all this, if majority memebrs and core still feel that this will be the only future standard for accepting donations then as I mentioned above, I will have only one option left and that is to wait till I become comfortable for donating $ 100/- ( I will remain emotionally charged...:))

This was the first time I participated in the event - I had no idea of what to expect and what can be achieved. I can honestly say that meeting all the people who attended the advocacy days showed me the dedication this group has and also realized that there was so much more to initiating laws and passing laws and how futile our arguments are on the forums regarding different categories in EB.

In the meetings that I attended either the staff knew little about our problems (green card backlogs and legal immigration) or they knew of our problems and told us about the vast hurdles in the political environment that keeps popping up and derailing immigration reform. However, at no time the issue of EB1, EB2, or EB3 ever came up!! At the end of Monday, most of us met to share our experiences and as far as I can remember none of them mentioned it either. There was a lot of discussion on what the staffers wanted to know about IV and the solutions it was proposing. We were met with both understanding as well as skepticism - and I believe our job is to have more discussion with them and to make them see our point of view.

Obviously we cannot be in DC to do this all the time, but I believe that we need to continue to keep in touch with these staffers as well as make repeated visits to the local district offices too. Two observations, many of the staffers wanted to know if we were from the district or the state that their offices represented - and even though IV tried to match this, we just lacked members from certain area, so fellow IVians, I request larger and wider participation in such efforts. Secondly, I have met with both my Rep as well as one of my Senators office locally, and when I mentioned it to the staffer in DC, she was very happy and was more receptive.

I want to take this opportunity to Thank IV for opening my eyes to a world that I live in but never cared to understand. The road ahead for us immigrants is hard and long, but now I have started to pave the road with IV leadership. The question is will it be just few working hard and long? Or can we hope for better with 40,000 members?

I am too sure you can get away with it. You are at fault for the below reason.

    1) Employing a person without checking their immigration status is an offense.
    2) It can come back and haunt you as you helped her in tax evasion. Employer by law MUST report to IRS for any compensation paid.
    3) Since the lady is going down, she might take you along with her...What will you do if the lady tells the cops that "she told you that she cannot work here legally and you told her that it is OK and I will pay you in cash"... It becomes a story of she said and he said. They have enough proof of you not legally employing her.

Ignorace of a law is NOT an excuse.

I might be totally wrong on this.. Check with a attorney.

If we can even collectively demand official data, which I think we are entitled to, it will help IV community in estimating the wait times for individual cases. It may also help USCIS in correcting their projections and forseeing the demand.

Count me in for any effort in this direction.

Well you never had any arguments points in the first place. All you had is a misplaced sense on self superiority.

But please don't run away from an argument try some logic for a change

can't argue with people who pretend not to understand.

Of millions of people only you say F1 is fraud. does a single person's opinion make it a fact?

Why don't u brush up your reasoning skills?

Congratulations on first success. All will enjoy the real fruits. This is just start. Finish is to get the bill passed for more visa numbers, more transparency in DOS / USCIS.
Thanks we will not forget your efforts.

I'll send the letters when the final draft is ready. I agree though, the final draft should address difficulties faced by both EB2 as well as EB3 if possible. On the other hand the particular argument made in this letter - against the USCIS ad hoc processing and not honoring PDs - is kinda difficult to make for EB3 cases since EB3-I was "U" at the same time. Unfortunately we do not have actual proof from the recent past where USCIS actually processed EB3 applications out of order which we have in case of EB2 category.

What are IV core's thoughts on this campaign? I would like to see some comment from IV core on this idea. If it can be made an official IV action item by the core I bet there will much more momentum behind this.

My wife has a Ph D and sent you the details. Let me know if you need further informaton
That really helps. But we need more stories from IV members. It need not be earth shattering like being a researcher in some cutting edge lab or an exec in a top 50 firm. We all have our own stories

If you read the first post, the senator (I think it was Kennedy) made a big deal about some immigrant he knew who had a very 'ordinary' life. All of us in IV are atleast one step ahead in the sense that we all are 'highly skilled'.

It could be about a Software Engineer who cannot get a promotion and has to reject more lucrative/satisfying offers from other firms to a person who is qualified as a High School teacher who cannot teach because she does not have an H1 visa

It could be about someone getting frustrated and applying to Canada as a backup otion or someone. Someone else might have a spouse who has been on H4 for 6 years and now cannot work inspite of avaiability of sponsor because one may use only 6 years of H visa.

Guys, unless we all chip in, lets forget about getting any resolution to this issue. IV is doing all it can and has been getting some success in getting amendments introduced. But unless we all step up to the plate, we can assure you it will be very difficult for us to protect these amendments in the senate. House conference will just chew us until we make some noise.

There are 3000 members on this forum, can't we even get a 100 decent stories to pass on to the media? Its difficult to convice media to write about us with only 5 people's stories......please chip in....as promised, no personal info about you will be revealed, unless you explicity mention that to us....
