    can pre adjudicated files also be sent to review or is it only to files that are not pre-adjudicated but are trying to pre-adjudicate

    the biggest stress is the window of opportunity is so small that the stress levels are going to be high. if not now then we have to wait for another year. for the first time in my life I can see why our elders used to give up on government activities and why they say have patience. here with uscis it seems like years are passing by like eons but uscis asks us to consider them as minutes or seconds.

    one of the ridiculous person at uscis when asked why i am not getting my ead in 90 days says this - sir there are people still waiting from a year to get their green card so please have patience and consider yourself lucky that it is just 90 days. what kidn of a screwed up person give such a response.

    seems like we have to go through this painful month once again. lucky people will get their green card - unfortunate ones will have to wait for however long it is

    I'll take that as the final word on this issue.

    And I expect people here to have enough integrity to let us (ROW) know if they intend to pursue the interests of the oversubscribed countries only, at the expense of the interests of the ROW.

    No one here takes advantage of any group. We are talking here is what law says and how it is implemented by various agencies. The problem is there is doubt that DOS has not understood the law. No one is against ROW and loves India and China. US immigration simply based on preference catagories. For example, wife of U.S citzen will be given first preference in immigration (FB1) compare to brothers and sisters of US permanent residents (FB4or5). This is the law.

    Similar thing in employment catagories too. Before 2000, there is a verical spill over of EB visas. Becase of this, a high skilled workers from India/China has to wait more compare to low skilled workers from ROW. This practice will not put US in technological edge. Thats why AC21 law implemented.

    After 2000, congress removed country quota in all EB catagoires. The simple reason is to make US competiveness in 21st century. The intend is simple.

    The simple meaning of AC21 law is, for example, let us assume following hypothitical situation. There are 40,000 noble prize winners from Mexico. All of them applying EB1 visas in a FY. In same FY, no one from other countries applied EB1 visa. As per AC21 rule, entire 40,000 visas (100%) goes to Mexico in EB1 irrsepective of how EB2 or EB3 or FE catagories are retrogressed or howmany mexians in EB/FB are waiting. This is what congress intend to promote high skilled immigrants to USA. This is what american competivness in 21 century. The intent here is noble prize winners should not wait even if they are from oversubscribed countries like mexico.

    If you read word by word of AC21 rule ..you will understand what I am saying.

    EMPLOYMENT-BASED IMMIGRANTS NOT SUBJECT TO PER COUNTRY LIMITATION IF ADDITIONAL VISAS AVAILABLE- If the total number of visas available under paragraph (1), (2), (3), (4), or (5) of section 203(b) for a calendar quarter exceeds the number of qualified immigrants who may otherwise be issued such visas, the visas made available under that paragraph shall be issued without regard to the numerical limitation under paragraph (2) of this subsection during the remainder of the calendar quarter

    My intension is simple.

    Even if SKIL/CIR bill passed in near future, if DOS or USCIS does not implement the law accordingly, it will be disaster for oversubscribed countries like India and China.

    Sorry Guys I am asking this question in different threads , as I am unable to conclude any solution for this problem..:o

    Let's assume B entered into US on Jan 1st 2004 with Visa stamping Valid till June 2006.

    B doesn't have payslips for period of 185 days(aggregate) in his whole stay in US , rest of the time he maintains legal status , but he never travels outside US and applies for his 485 in March 2006.

    In this case B is under risk of illegal status for more than 180 days , as he never travelled outside US.

    OK agreed , when it's a law we should abide by them.But what are the other options available for B? He can't be covered under 245(K) so this option is ruled out.He needs to forget about GC? Will it be helpful if he contacts good lawyer any hope? Or just rely on luck?

    Folks,

    I edited the letter so please take a look at this version. Some of you'll have suggested I condense the letter to a series of questions alone - I think this is a good idea and will be more effective in capturing attention. I will prepare something in this format (but it will have to wait for the weekend).

    For now, my intent with this letter is to ask that the ARBITRARY nature of the visa bulletin be put to an end. I am exhausted by the cycle of raised and dashed hopes when the visa bulletin moves forward and backward.

    To those of you'll who brought up the issue of schisms between EB2 and EB3, please read paragraph two above. Let us correct this randomness before we tackle each of the issues that are making life so difficult for us. You could start by gathering your friends, co-workers and other EB3 applicants and put together your list of issues to be addressed along with solutions. My view is that if USCIS is incapable of taking care of the matter then we have to pitch in and suggest/prod/request/demand it of/from them.

    Together we can do it!

    Sir/Madam,

    On behalf of the employment-based legal immigrant community in the United States of America, I am writing to highlight the ongoing egregious inefficiencies in the immigration “services” provided by the USCIS and the DOS. There have been numerous occasions when there have been erratic movements in the DOS published visa bulletin dates. This, as we understand it, is owing to USCIS under- or over-estimating the number of applicants available for adjustment of status. And in the rare instances when the date finally moves forward by a substantial window, USCIS tends to approve the more recent applications as opposed to the ones that were filed earlier. Let me explain with an example: in the July 2008 visa bulletin, the cut-off date for the India EB2 category was 01 April 2004. A month later, the cut-off date for Indian EB2 applicants abruptly moved forward two years and was set at 01 June 2006. Instead of approving applicants who applied in 2004 and 2005, USCIS approved applicants from 2006. Where is the justice in that??? Why bother publishing the cut-off date if approvals are to be randomly allocated???

    We understand we have to stand in line and wait our turn. Each applicant is assigned a priority date which chronologically determines his/her turn for approval. To further complicate matters, once the I-485 is filed, a crop of other dates are issued by the USCIS – a receipt date, a notice date and a processing date. USCIS then takes the liberty to throw random rules at us – “Case adjudication is based on receipt date” “No, we process applications based on notice date”, “Actually, it’s the processing date that determines which applications are adjusted.” !!!

    Please take a moment to consider how these conflicting statements and arbitrary decisions wreak havoc on our morale and psyches? No one, NOT even the USCIS, has a clue as to what exactly is happening in their processing centers. The USCIS has never been able to clearly state the exact number of applications languishing, excuse us, we meant pending, in their “service” centers! We, employment-based immigrants, are tax-paying, law-abiding, educated individuals contributing to America’s knowledge economy - yet we have been subjected to the worst aspects of the US employment-based immigration system. These include:

    1) Extended wait times at each step of the immigration process.
    2) Lack of transparency on the part of USCIS (re: priority date, receipt date, notice date).
    3) Lack of USCIS customer service – once applications are submitted to USCIS they disappear into a black hole. Barring a website where one nominally can check one’s case status (but which in reality remains static for months, even years!) there is no concept of updating an applicant on where his case stands. And this is despite the applicant paying immigration fees that often run into thousands of dollars over the years. We are simply expected to wait in a complete void of information, for however long it may take, until approval.
    4) Lost opportunities owing to the lack of job portability during the process (a time period spanning an average of five years, whereas an applicant from any country besides India gets his/her PR card in under two years).

    While we are grateful for the opportunity to partake in the American dream, it is ironic that we arrive in America and find that our freedom is shackled – we are bound to our sponsoring employer from the start to the end of the extremely lengthy process. Although legal immigration reform is our ongoing aim, for now, we sincerely request you to investigate the process whereby the monthly visa bulletin is set and to ensure FIFO (first in, first out) adjustment so that those of us who have been waiting longer receive attention prior to those who have applied later. We want USCIS to be accountable to us, its paying customers.

    We request you to lend us your ear and address these issues so that we are not subjected to them in the future.

    But do understand one thing. We want to pass these stories to senators and media folks to show them how badly messed up the system is. If you really want to help, please send me by email a decent (no *&^% ;-) ) version of your story. Only then we can really use it!

    Again, do not get me wrong. I totally understand your frustration and can fill up an entire page myself with obscenities at the utter incompetency and malicious intent of employers/lawyers. But will it do any good? Probably serve as a vent for my frustrations but not much beyond that!

    So do yourself a favor and send me a detailed email with all the info mentioned in the first post and we will make sure we add it to the list of stories that we pass on to the senators!

    Even if you assume there are 3000-5000 labor subs that chocks up the queue, it might have benefited the ones with a 2003 PD like yourself. But for others (beyond 2003) , it is not much of a help. A visa recapture would benefit the community at large.

    Even if you consider 3000-5000 labor subs, not many of those are "sold" labors, many of them are legal ones. labor subs were all legal until some companies started selling those.

    Hi.. I'm not discussing whether labor subs is legal or not. Prior to July 2007, the law & regulations allowed to utilize the labor cert, that was certified for a Alien with a diff Alien, provided skill, edu... etc matches. Though it is legal, the amount of mis-use led to sunset of the program after many many years of existence.

    My argument is that Labor Sub, does impact PD movement significantly, Also most people I know with PD prior to 2002 , except very few unlucky ones most got their GC. Also in July 07 rush, many who had already filed 485 with PD 2003 and early 2004 also got approved.
    I know there were lots of approvals from Backlog Elimination center, but unless you work for a very good company, I doubt you will still be stuck with the employer from 2000 just for the sake of GC. When the dates were current, many moved to other companies, If you were here in US during late 2000 and 2001, that was not nice year for IT / Tech. Now where did all these old PD's pop from. Definitely sub has a big role to play. As I said in my earlier post, nothing can be done abt. this.

    Visa recapture and visa increase seems to be the only option that might help.... and most member now know what it takes to get there... $$$$ and more $$$$$ to lobby, etc...

    I would say for EB-2 India

    In 2005- 2500

    But I do not know how many would be EB-2 India in 2004 between Apr.-Dec.

    I looked at the links you have provided and I'm still not sure where your "50,000 EB2 India Labors...." came from. These numbers do not seem trustworthy or reliable.

    Here's data directly from the DOL ETA website.....
    3/28/2005 to 10/28/2005 there were a total of 15973 Labor certifications approved - that includes EB1, 2, 3, 4 for all countries, and 3734 cases for Indian nationals in EB1, 2, 3, 4. Of course a part of EB1 and all of EB5 don't need labor certs.

    If you download the database from the DOL website, apply filters for India, approved cases, then filter out all Level I in all non-managerial occupations, followed by non EB2 job descriptions - you end up with ~ 8 - 9% approvals for EB2-IN which is approx 1300 - 1400 primary applicants.
    In my estimates, i removed most computer programmer level occupations as the USCIS has been very reluctant to approve EB2 for these cases - i could be wrong here.
    As you see, it is IMPOSSIBLE for EB2 IN cases between 3/28/2005 to 10/28/2005 to be much more than 3800 (that is approx 3800 x 2 visas incl dep).
    A total of nearly 50000 EB2 IN applicants (including dep) for 2004 and 2005 may be possible.

    The massive retrogressions we are seeing is mainly because of the fact that only 15439 EB2 visas were issued in 2003, and 32532 i 2004 thanks to DOL backlogs and mis-interpretations of the law by DOS !!!! compare that with an average of 43,000 in most other years since the 1990s.

    1) We got a spike in new membership and funds
    2) We now have atleast 2 more NATIONAL publications who have taken notice of our activities and are more sympathetic to our causes. They feel we have a compelling story and they are interested in publishing about our plight...

    In fact two IV members are being interviewed today by a leading publication.

    and the most important
    3) We got additional material to provide to senators and their staff...this really helps as we do not have to establish ourselves....our stories along with newspaper articles help make our case much stronger....

    When we initially started meeting senators, their staff would ask QGA 'Immigration Voice, who or what is that?'

    Lately when we go to meet them, most of the staff have already visited our sites multiple times, know about us because of phone calls and faxes by members and ofcourse the articles that have been published....on top of this when we provide stories of members from their constituency, 50% of our work is already achieved....the liason team and QGA take over from there.

    So to answer your question, yes it helped a lot

    Thanks Ragz4u. We shud try and publish info like this on the website in an "Recent Updates/Activity" section. That section will give not only what IV is doing currently but also what the impact is. Now i dont know if that will have adverse consequences, but if it wont then we shud publish more such info on the site. This will convince the fence sitters to contribute and participate more actively. We have the forums on the extreme right, above or below that we shud have a "Live/Recent Updates/Activity" or a link updated as frequently as possible. There was a saying that "IV never sleeps". I think it is time that the people visiting IV and it's forums know that and know what all is going on.

    Does that sound like a good idea, or is it going to have adverse effects?

    This is ridiculous. Just trying to blame a good Sherrif.

    I am from AZ and Sherrif Joe is the best and the whole country should be proud of him.
    He is doing the job which is supposed to be done by Federal govt and ICE, trying to take care of a border state county.
    Well you always have critics when you are doing a good job or he wont keep getting elected again and again.

    I'm from AZ too but that's besides the point. We are definitely not discussing if Sheriff Joe is the best or not. Being humane is what most people are talking about.

    I understand JSB.

    But question is how long is long...it comes down to sheer luck and chance which pre-adjudicated cases USCIS considered recheck and which they don't.

    Also they may simply deny looking into my case even if preadjudicated by the ND of I-485 receipt being outside the window.

    But again why are we trying to reason.

    In the "Ask a lawyer" forum...attorney Ms Reddy mentioned USCIS is sending RFEs to all cases for possible preadjudication....and since she does not mention that multiple RFEs are impossible, I assume any preadjudicated case can get an RFE so the very term preadjudication is meaning less if it needs adjudication again.

    And since you are putting time frame...and window of opportunity is far and few in between so essentially preadjudication is not a confirmed ticket to Greenhood.

    My 2 cents.

    there is such a huge backlog for Indians that even the news above won't help much... overflow from family category has slowed down and previous recaptured visas are over ..the news that CIR has been delayed could be good as there is higher chance that there maybe some sort of relief ..other than that the situation is HOPELESS !!!

    good work Sherman_tribiani, i am watching this group of "highly skilled job stealer� for sometime. they merely talk and do nothing. most of them r scared to do anything. they r scared of u & me. they r not scared when they steal our jobs and we will scare the hell out these ba$tard$ to make them do in their pants before we kick them out. gheen told me about this group and he also said that not to waste my time on these job stealers as they r weak and incapable of doing anything, other than stealing our jobs and outsourcing.

    We know how to do THESE JOBS RIGHT...and SHOW you how to do it effeciently and effectively.....:rolleyes:

    This is in reply to sam2006 above. I had an LUD on my I140 on 7/28/07 but my application was mailed to TSC directly.
